What is a no fault divorce?
A No-Fault Divorce replaces the ‘five grounds’ and allows couples to Divorce without assigning fault to either party. It removes the possibility of contesting the Divorce. It also introduces an option for a Joint Application. It removes the ‘blame game’ from the process, giving everyone equal standing and the right to walk away from a relationship that has run out of steam without having to alienate an ex-spouse by falsely accusing them of ‘unreasonable behaviour’.
Changes remove unnecessary conflict to ease stress on couples and children.
New minimum wait of 20 weeks between Application and Conditional Order of Divorce.
